Apostille in Zaporizhya city

In order to simplify the process of recognition of foreign documents in 1961 in The Hague (Netherlands) the Convention abolishing the requirement of legalization for foreign public documents (Hague Convention) was signed.

In accordance with The Hague Convention on the documents executed by the competent authorities of a State and intended for use on the territory of another State, a special stamp must be placed. – This is the 2nd way. It can be placed directly on the document or placed on a separate sheet attached to the document. “It certifies the authenticity of the signature, the capacity in which the person signing the document, and, where appropriate, the identity of the seal or stamp which the document bears” (Article 5). Signature, seal or stamp which are placed by the competent authorities on the document, don’t need any further certification or legalization and the document which has signature, seal or stamp can be used in any of countries - participants of the Hague Convention.

However, legalization and affixing is not required if abolition or simplification of these procedures are provided by international agreement. For example, by bilateral treaties on mutual legal redress and the Convention on Legal Redress and Legal Relations in Civil, Family and Criminal cases dated 22 January 1993 it is foreseen that the documents which are made on the territory of one Contracting Party or certified by the agency or specially authorized body within the limits of their competence and in the prescribed form and affixed the official seal are not required any certificate (legalization) on the territory of another Contracting Party. In respect of such documents only their notarized translation may be required. Participants in this convention are: Belarus, Uzbekistan, Kazakhstan, Russian Federation, Tajikistan, Armenia, Ukraine, Kyrgyzstan, Moldova, Turkmenistan, Azerbaijan, Georgia.

Apostille is a special stamp which is placed on official documents of non-commercial content issued by the agencies and organizations of the member states of the Hague Convention about abolishing of requirement of legalization for foreign public documents (signed on October 5, 1961). It confirms the authenticity of the signature and the capacity in which the person signed the document, and, in some cases, the authenticity of a stamp or seal which the document bears. It does not require further certification or legalization and is valid for the official authorities of all Member States of the Convention.
